REPORT AND ORDER



WHEREAS:

By application filed with the Division of Public Utilities and Carriers, ("Division"), Carol Capasso-Giammarco, DBA: C. Corty Trucking, 77 Puritan Avenue, Cranston, RI 02920 seeks to transfer the operating rights contained in Certificate No. MC 2316, in accordance with Rhode Island General Laws, Title 39, Chapter 12, to C. Corty Trucking, Inc., 77 Puritan Avenue, Cranston, RI 02920.



WHEREAS:

Following a notice of hearing in this matter, the Division held a transfer hearing on May 9, 2000.

Carol Capasso-Giammarco, pro se, for the Transferor and Transferee



FINDINGS

After a review of the record in the proceeding, the Division has determined that the Transferor has been actively providing transportation services under Certificate No. MC 2316 and that the Transferee is fit, willing and able to provide the service required under this certificate. The testimony of the Transferee and the evidence of record demonstrates that the Transferee has the necessary equipment, experience and financial responsibility to provide the proposed transportation service.



No persons appeared at the hearing in opposition to the granting of the transfer.



Accordingly, it is

( ) ORDERED:That the application seeking the transfer of Certificate No. MC 2316 which authorizes the transportation of bulk commodities is hereby granted.

  1. That the approval and granting of the instant application is subject to the Transferee hand delivering to this office within sixty (60) days from the date of this order the following:
  1. letter of consummation signed by both parties,
  2. proof of financial responsibility (liability and cargo insurance) from an insurance company ($10.00 filing fee),
  3. all vehicles intended to be used in the operation of the business must be registered with this office ($20.00 fee, per vehicle),
  4. Applicant shall not perform the services authorized herein until such time as the Division has formally approved the Transferee's proposed tariff.

2. If the conditions contained in Paragraph 1 are not met within the sixty (60) day period, the approval herein granted will be of no further force and effect.
